if I am charged with theft of $250 what sentence can I expect?
work in a nursing home went shopping for her and now im being accused of taking the items. my home has been searched and the havent found anything.

This is a UK based site so we are not experts in US law but from the description of events you shouldn't be worrying about what sentence you should expect but whether you will be found innocent or guilty. In fact, before that, whether you will be charged. If you are charged with this offence, you will need legal representation (this will be supplied by the state if necessary) and they will be able to tell you of the likely result if you are found guilty.

If you plead guilty at the first hearing, you will probably get around 180 hours Community Service and a £50 fine, plus Prosecution costs (£60). If you plead Not Guilty and let it go to Trial, a very small Custodial sentence may be possible.


Supplement from 02/13/2007 12:05pm:

Although, if they didn't find these 'stolen' items, Prosecution will offer no evidence and you will be acquitted.
